Some types of birthing injuries are temporary; while others can be long term or permanent. Many of the types of injuries sustained during birth can be prevented when proper medical procedures are followed. Medical negligence can cause several types of birth injuries. Medical negligence (also referred to as medical malpractice) is defined as a health care provider's failure to exercise the same degree of judgment, care, and skill that a prudent medical professional would exercise in similar circumstances. Birth injuries are serious, and can have lasting effects on a baby's development, sometimes altering a newborn's life permanently.

Examples of birthing injuries are:

  • Brain damage can occur if the baby is deprived of oxygen, possibly if the umbilical cord wraps around the baby's neck.

  • Cerebral palsy is one of the most serious types of birth injuries that a child can develop. There are many factors that can contribute to these types of birth injuries.   • Brachial Palsy (also known as Brachial Plexus Palsy, Duchenne's Palsy, Klumpke's Palsy, and Erb's Palsy) occurs when the nerves that control arm and hand movement are damaged during delivery, particularly if the baby is delivered through the birth canal and the baby's shoulders do not have the easiest times passing through the canal. This injury can result in paralysis in the upper arms, and can require surgical correction.
  • Fractures can occur during childbirth. The most common forms of this injury are fractures of the baby's clavicle or collarbone. This type of injury is more common in breech births.
  • Facial paralysis affects a newborn's face. This injury occurs with excessive pressure on the face during delivery and may require surgery to correct.

Negligence or recklessness by a physician can take on a variety of roles. When complications in child birth occur, a doctor must act promptly. If a physician fails to recognize a complication, such as if the baby's size will prevent the baby from safely passing through the birth canal unscathed, then that physician is negligent and can be held accountable for injuries that the baby sustains as a result of the physician's failure to act.

If a physician does not order a cesarean section (C-section) when it remains the only safe way of delivering the baby, then the physician can also be held liable. Furthermore, if the physician is too rough during the childbirth, that is, as he or she is helping extract the baby from the birth canal, then injuries sustained by the baby, injuries that may not have been inflicted upon the baby otherwise, are the fault of that physician.
