PRODUCT: Women's robes and other garments sold by Blair LLC of Warren, Pa. in Blair catalogs, online and at Blair stores in Warren, Pa.; Grove City, Pa.; and Wilmington, Del., from July 2000 through April 2007. The products are all made by A-One Textile & Towel, of Karachi, Pakistan.
HOW MANY: About 300,000 garments, including the full-length women's chenille robes, women's chenille jackets, women's chenille lounge jackets, and women's chenille tops.
WHY: Some of the products failed to meet federal flammability standards and present a risk of serious burns if the garments are exposed to an open flame. Blair initially recalled about 162,000 garments in April 2009 after the company learned of three robes catching on fire, including one report of second-degree burns. Since the April recall announcement, Blair received nine reports of deaths involving the originally recalled robes. Most occurred when the victims were cooking, the Consumer Products Safety Commission said.
Strict Liability
Products liability claims can be based on negligence, strict liability, or breach of warranty of fitness depending on the jurisdiction where the claim is based.
Product Liability is generally considered a strict liability offense. Strict liability cases do not depend on what degree of carefulness a wrongdoer took. It is not relevant whether the manufacturer or supplier exercised great care; if there is a defect in the product that causes harm, he will be liable for it.
According to the recall announcement by the Consumer Safety Product Commission, some of the recalled robes failed to meet federal flammability requirements and present a risk of serious burns to consumers if they are exposed to an open flame.
The products that Blair manufactured and sold to its customers were dangerous and defective and Blair is strictly liable for any injuries and deaths caused by their robes.
