THE FACTS:
Yaz and Yasmin are combined oral birth control pills that contain ethinyl estradiol and drospirenone.
The only birth control pills available for sale in the United States that contain drospirenone are Yaz and Yasmin.
Yaz and Yasmin are manufactured by Bayer Corporation, formerly known as Berlex Laboratories, Inc. and Berlex, Inc.
Sales for Yaz and Yasmin increased sharply in 2008, largely due marketing campaigns that the Food and Drug Administration has called "misleading" and "deceptive."
WHAT IS DROSPIRENONE AND HOW DOES IT AFFECT THE BODY?
Drospirenone adversely affects the body's ability to regulate a balance between salt and water, resulting in elevated potassium levels - a condition called hyperkalemia. Hyperkalemia can cause potentially life-threatening heart problems and other related health issues.
LAWSUITS
According to several allegations, Yasmin and Yaz side effects could increase the risk of:
- Deep Vein Thrombosis (DVT)
- Pulmonary Embolism (PE)
- Gallbladder Disease
- Heart Attacks
- Strokes
- Cardiac Arrhythmias
- Sudden Death
The Yaz and Yasmin lawsuits claim that the Bayer Corporation was negligent in several ways including:
- Marketing and selling Yaz as safe and effective for use in the prevention of pregnancy
- Failing to adequately warn consumers of unreasonable and dangerous side effects
- Failing to conduct adequate pre-clinical testing and post-marketing studies to determine the safety and side effects of Yaz
- Failing to use ordinary care in designing, testing and manufacturing Yaz
- Failing to exercise due care when advertising and promoting Yaz.
ORGANIZATIONS AND PUBLICATIONS AGAINST YAZ AND YASMIN
Public Citizen, a consumer advocacy group, has placed Yasmin on its "Do Not Use" list of drugs.
British Medical Journal, in 2002, identified 40 cases of venous thrombosis among women using Yasmin. Almost a year later, British Medical Journal discussed another 5 reports of Yasmin problems involving thromboembolism, including at least two deaths.
The Food and Drug Administration has given Bayer Corporation two warnings - the first in 2003 and the second in 2008. The most recent warning from the FDA reprimanded Bayer, claiming the Yaz television advertisements misled the public by inflating the drug's efficacy while minimizing the risk of side effects. Bayer has since been ordered to spend $20 million correcting the campaign as well as agreeing to restrictions requiring Bayer to submit further Yasmin/Yaz ads to the FDA for review before they launch on air.
